Terms & Conditions
Note: This is a draft. These terms will be reviewed by a lawyer before the official launch. Details in square brackets are still to be completed.
1. Scope and provider
These Terms & Conditions govern the use of the online services operated by David Schubert, [address], Germany ("Provider"), in particular community and website features provided as software-as-a-service ("Service"). Deviating terms of the customer do not apply.
2. Registration and account
Certain features require a user account. Registration details must be accurate. Access credentials must be kept confidential; actions taken under an account are attributed to the account holder to the extent they are responsible for them.
3. Services and plans
- The Service is offered in different plans (currently Free, Pro and Business); the respective feature set follows from the service description at the time of subscription.
- The Provider continuously develops the Service and may change features as long as the purpose of the contract is not endangered and the change is reasonable for the customer.
- The Provider strives for high availability but does not owe uninterrupted accessibility. Where possible, maintenance is performed during low-usage periods.
- Usage limits per plan (for example posts per day) may apply to protect the operation of the shared platform; they are stated in the service description.
4. Prices and payment
Prices follow from the current price list. Payment is processed by Stripe, monthly or annually in advance depending on your choice. In case of default of payment, the Provider may restrict access to paid features after prior notice.
5. Term and termination
Paid plans renew automatically for the chosen billing period. Customers may cancel at any time effective at the end of the current billing period (via the subscription management in the customer area). After expiry, the account falls back to the free plan. The right to terminate for good cause remains unaffected.
6. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. [The withdrawal instruction and model withdrawal form will be added before launch.]
7. User obligations and content
Users must not post unlawful content, in particular content that is defamatory, harmful to minors or infringes third-party rights. Users remain responsible for their content and grant the Provider the non-exclusive rights necessary to operate the Service (storage, display, technical reproduction). The Provider may hide or remove reported or obviously unlawful content and may suspend accounts in case of repeated or serious violations. Automated mass posting (spam) and attacks on the availability or security of the Service are prohibited.
8. Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of slight negligence, the Provider is only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected. For free services, the Provider is liable only for intent and gross negligence.
9. Privacy
Information on the processing of personal data can be found in the Privacy Policy.
10. Changes to these terms
The Provider may amend these terms with effect for the future where necessary for good reason (e.g. changes in law or functionality). Changes will be announced in text form at least four weeks before they take effect; if the customer does not object within that period, the amended terms are deemed accepted. The announcement will point out the right to object and its consequences.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of their state of residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
